Agreement to Terms
By accessing or using DiverseCiti ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Platform.
We may modify these Terms at any time. Your continued use of the Platform after any changes indicates your acceptance of the modified Terms. We encourage you to review these Terms periodically.
About DiverseCiti
DiverseCiti is a residential community platform designed for residents of San Francisco, California. It connects neighbors at the building, block, and neighborhood level, allowing them to communicate through community-based posts and discussions. Our goal is to foster connection and collective awareness among people who share the same physical space.
Eligibility
To use DiverseCiti, you must:
- Be at least 13 years of age
- Have the legal capacity to agree to these Terms
- Not have been previously banned from the Platform
By using the Platform, you represent and warrant that you meet these eligibility requirements.
Account Registration
To access the Platform, you must create an account. When creating an account, you agree to:
- Provide accurate and complete information, including your real name and address
- Maintain and promptly update your account information
- Keep your login credentials secure and confidential
- Accept responsibility for all activities under your account
- Notify us immediately if you suspect unauthorized access to your account
You may set a display name that differs from your full name. Your display name is what other community members will see. Your full name is only visible to you in your account settings.
Residency and Community Membership
DiverseCiti connects you with communities based on where you live. To join location-based communities, you must provide your place of residence (address). By providing this information, you:
- Represent that you actually reside at the address you provide
- Understand that your address is used to determine your community memberships (building, block, neighborhood, city)
- Acknowledge that your exact address is never displayed publicly to other users
- Agree that providing false residency information may result in account termination
- Understand that you may optionally verify your residency by allowing one-time access to your device's location. Location access is voluntary — it is used only at the moment of verification and your GPS coordinates are not stored.
Community memberships are assigned automatically based on your address. You may have memberships at the building, block, neighborhood, and city level depending on where you live.
Acceptable Use
When using DiverseCiti, you agree not to:
- Post false, misleading, or deceptive content
- Impersonate any person or entity
- Harass, bully, threaten, or intimidate other users
- Post hate speech, discriminatory content, or content that promotes violence
- Share personal information of others without their consent (doxxing), including names, addresses, phone numbers, or other identifying information
- Target or single out specific individuals or protected groups
- Post spam or promotional material
- Upload malware, viruses, or other harmful code
- Attempt to gain unauthorized access to our systems or other users' accounts
- Use automated tools to access the Platform without permission
- Circumvent any security measures or access restrictions
- Violate any applicable laws or regulations
Content Guidelines
Posts and replies on DiverseCiti should be relevant to your community and respectful of your neighbors. When posting, please:
- Be respectful of others in your community
- Avoid identifying specific individuals without their consent
- Focus on topics relevant to your building, block, or neighborhood
- Provide context that helps others understand your perspective
User Content
Your Rights
You retain ownership of the content you create and share on DiverseCiti. By posting content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute your content in connection with operating and improving the Platform.
Translation
Posts and replies may be automatically translated into other languages using third-party translation services (Google Cloud Translation) to help community members read content in their preferred language. While we strive for accuracy, translations may not perfectly capture the original meaning or intent.
Content Moderation
We reserve the right to remove any content that violates these Terms or our content guidelines, at our sole discretion. We may also suspend or terminate accounts that repeatedly violate our policies.
Push Notifications
DiverseCiti may request permission to send push notifications to your device to alert you about new posts and replies in your communities. Enabling push notifications is entirely optional. You can manage your notification preferences at any time in your account settings, or revoke permission through your browser or device settings.
If you enable push notifications, a device-specific subscription identifier is stored on our servers solely for the purpose of delivering notifications to you. This data is deleted when you disable notifications or delete your account.
Anonymous Posting
DiverseCiti allows you to post and reply within your communities without displaying your name to other members ("anonymous posting"). When you post anonymously, your display name is hidden from other community members. However, your identity remains associated with the post in our database and is visible to us for moderation and safety purposes. Anonymous posting does not constitute complete anonymity.
Privacy
Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information. By using DiverseCiti, you consent to our data practices as described in the Privacy Policy.
Account Deactivation and Termination
Account Deletion
To permanently delete your account and all associated data, please contact us at support@diverseciti.org. Account deletion is irreversible.
Termination by Us
We may suspend or terminate your account if you violate these Terms, engage in harmful behavior, or for any other reason at our discretion. We will attempt to notify you if your account is terminated, unless doing so would be inappropriate (for example, if termination is due to illegal activity).
Intellectual Property
The DiverseCiti name, logo, and all related trademarks, graphics, and designs are our property or the property of our licensors. You may not use these without our prior written permission.
The Platform and its original content (excluding user-generated content), features, and functionality are owned by DiverseCiti and are protected by copyright, trademark, and other intellectual property laws.
Disclaimer of Warranties
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
We do not warrant that the Platform will be uninterrupted, error-free, or secure, or that any defects will be corrected. We do not endorse or verify the accuracy of user-generated content.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DIVERSECITI AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM.
IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED ONE HUNDRED DOLLARS ($100) OR THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRIOR TO THE CLAIM, WHICHEVER IS GREATER.
Indemnification
You agree to indemnify, defend, and hold harmless DiverseCiti and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Platform, your content, or your violation of these Terms.
Dispute Resolution
Any disputes arising out of or relating to these Terms or the Platform shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in San Francisco, California, in accordance with the rules of the American Arbitration Association.
You agree to resolve disputes on an individual basis and waive any right to participate in a class action lawsuit or class-wide arbitration.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in San Francisco County, California.
Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and DiverseCiti regarding your use of the Platform and supersede any prior agreements.
